Small Business Concern

The SBA, for most industries, defines a “small business” either in terms of the average number of employeesover the past 12 months, or average annual receipts over the past three years. In addition, SBA defines a U.S.small business as a concern that:
  • Is organized for profit;
    Has a place of business in the US ;
    Operates primarily within the U.S. or makes a significant contribution to the U.S. economy through payment of taxes or use of American products, materials or labor;
    Is independently owned and operated; and
    Is not dominant in its field on a national basis.
The business may be a sole proprietorship, partnership, corporation, or any other legal form. In determining what constitutes a small business, the definition will vary to reflect industry differences, such as size standards.

Small Disadvantaged Business Concern

A small business that is at least 51% owned by one or more individuals who are both socially and economically disadvantaged, or a publicly owned business having at least 51% of its stock owned by one or more socially and economically disadvantaged individuals and has its management and daily business controlled by one or more such individuals.

Small Business Size Standards

The Florida Department of Transportation uses the US Department of Transportation (USDOT) definition of a small business as defined by 49 CFR 26.65.  The USDOT definition uses the Small Business Administration (SBA) definition which has different size standards for the type of work performed.  The USDOT definition limits the size standard to $22.41 million.  A business determines their size by averaging their annual gross receipts over the last three years.  If their average gross receipts are under the SBA size standard for a particular type of work and under $22.41 million, the business would be considered a small business.

Socially and Economically Disadvantaged

Individuals who are identified as a member of an ethnic group. This includes Black Americans, Hispanic Americans, Native Americans (American Indians, Eskimos, Aleuts, and Native Hawaiians), Asian-Pacific Americans (U.S. citizens whose origins are from Japan, China, the Philippines, Vietnam, Korea, Samoa, Guam, and the U.S. Trust Territories of the Pacific, Northern Marianas, Laos, Cambodia and Taiwan), and Asian-Indian Americans (U.S. citizens whose origins are from India, Pakistan, and Bangladesh). Other groups or individuals may be considered disadvantaged if certification is granted by the Small Business Administration according to Section 8(a) of the Small Business Act.

Two or More Races (not Hispanic or Latino)

A person who identifies with more than one of the other races i.e., white, black, American Indian or Alaskan Native, Native Hawaiian or other Pacific Islander, and/or Asian.

Unified Certification Program (UCP)

The purpose of the UCP is to provide “one-stop shopping” to applicants for certification, such that an applicant is required to apply only once for a DBE certification that will be honored by all recipients in the state. In the past, a firm would be required to apply for certification as a DBE with each agency with which the firm wants to work.  Under UCP, the firm applies one time with the state transportation agency, and if approved, that certification is shared by all other federal recipients in the state. The UCP eliminates the need for multiple DBE certifications with recipients of funding from the U.S. Department of Transportation.

Women
