| Bond Guarantee Program (BGP) | The Bond Guarantee Program (BGP)is a financial support program which the State of Florida acts as a second surety, guaranteeing the construction bonds for DBEs working on FDOT projects. Participation in the BGP is limited to those DBEs who have been awarded a Certificate of Proficiency and have documented knowledge of the principals of construction bonding. Services under the BGP include: Packaging Bond Applications, Construction Bond Principals Seminars and Overhead Audits, a one time free service for DBEs seeking pre-qualification as a consultant. | Construction Management Development Program & Bond Guarantee Program | The Construction Management Development Program (CMDP) is a voluntary program designed to improve and develop the skills of small business owners and managers enabling them to perform successfully on FDOT construction projects. Courses offered are Business Management, Construction Accounting, Construction Math and Estimating, Contracts, Specification and Law, Scheduling for FDOT and Plan Reading for FDOT. Participation in the CMDP is open to firms certified as a DBE by the Florida Unified Certification Program or a small business firm whose annual gross receipts do not exceed $2 million dollars average over the last three year period. Contractor | The individual, firm, joint venture, or company contracting with the Department to perform the work. A) prime contractor: A company having a contract with the FDOT. B) Subcontractor: A company having a contract with a prime contractor or subcontractor regardless of tier. C) Tier indicates that a company is subordinate to another company on the contract. A subcontractor is first tier to the prime. A company that subcontractor engages is ―2nd tier, and if they in turn engage another company, that company is ―3rd Tier. |
Disadvantaged BusinessEnterprise (DBE) | A for-profit small business concern (1) That is at least 51 percent owned by one or more individuals who are both socially and economically disadvantaged or, in the case of a corporation, in which 51 percent of the stock is owned by one or more such individuals and (2) Whose management and dailybusiness operations are controlled by one or more of the socially and economically disadvantaged individuals who own it. |
DBE Supportive Services | Supportive services are those activities and services that are designed to contribute to the growth and eventual self sufficiency of DBEs so that they may achieve proficiency in competing for contracts and subcontracts. The purpose of the DBE Supportive Services Program is to increase the number of certified DBEs participating in the highway program and to contribute to the growth and eventual self-sufficiency of DBE firms. The Department’s statewide DBE Supportive Services provider provides managerial and technical assistance to certified DBEs participating in the highway program at no cost. Participation in the DBE Supportive Services Program is open to firms certified as a DBE by the Florida Unified Certification Program. The DBE Supportive Services provider is available to assist prime contractors with locating DBEs on the Department’s online business directory and matching primes with DBEs for subcontracting/sub consulting/supplier opportunities. The Equal Opportunity Reporting System (EOR) | The Equal Opportunity Reporting (EOR) system is an internet based tracking system that consists of three separate components, BizWeb, BizNet and BizTrak. BizWeb and BizTrak are the two components that are relevant to EEO Construction Contract Compliance. A revision to the EOR system is targeted for release in 2012. |

Invitation To Bid (ITB) | A formal Purchasing document used whenever items, materials, or services can be individually priced, and/or where per-hour or per-unit charges can be used. If all other legal, base line, and documentary requirements have been met (bidder’s experience, past performance, DBE compliance, etc.), price is the only factor considered in awarding the contract. Bid openings are public. |

Minority (or Minorities) | Persons of Black, Hispanic, Asian or Pacific Islander, American Indian or Alaskan Native races. The term may mean these groups in the aggregate or an individual group. |
Minority Business Enterprise | A minority-owned business is a for-profit enterprise, regardless of size, physically located in theUnited States or its trust territories, which is owned, operated and controlled by minority group members. “Minority group members” are United States citizens who are Asian, Black, Hispanic and Native American. Ownership by minority group members means the business is at least 51% owned by such individuals or, in the case of a publicly-owned business, at least 51% of the stock is owned by one or more such individuals. Further, the management and daily operations are controlled by those minority group members. |

Responsible Bidder or Submitter | A bidder or submitter that has the capability in all respects to perform fully the contract requirements, and the integrity and reliability that will assure good faith performance. |
Responsive Bid or Proposal | A bid or proposal that conforms in all material respects to the IFB, RFP, or RFQ. Responsiveness pertains to whether or not a submitter or bidder has submitted all of the documents and information requested in the ITB, RFP, or RFQ, and whether or not those documents are properly executed according to the instructions in the ITB, RFP, or RFQ. |
Request for Proposal (RFP): | A formal Purchasing document used when experience, past performance, resources, and other criteria may outweigh cost. After proposals are submitted and reviewed, the Department may engage in discussions or negotiations with selected firms in order to obtain the best terms for the Department. |
Request for Qualifications (RFQ) | A formal Purchasing document used when it is desirable to establish a pre-qualified pool of companies contracted for certain (usually professional) services that may be required “from time to time.” Once the pre-qualified pool is in place, the Department of Purchasing, on behalf of the user department, issues Requests for Proposals for specific projects to all members of the pool — or all members of a category within a pool — throughout the contract period, without the requirement of public advertising for each project. |
Small Business Concern | The SBA, for most industries, defines a “small business” either in terms of the average number of employeesover the past 12 months, or average annual receipts over the past three years. In addition, SBA defines a U.S.small business as a concern that:

Small Business Size Standards | The Florida Department of Transportation uses the US Department of Transportation (USDOT) definition of a small business as defined by 49 CFR 26.65. The USDOT definition uses the Small Business Administration (SBA) definition which has different size standards for the type of work performed. The USDOT definition limits the size standard to $22.41 million. A business determines their size by averaging their annual gross receipts over the last three years. If their average gross receipts are under the SBA size standard for a particular type of work and under $22.41 million, the business would be considered a small business. |
Socially and Economically Disadvantaged | Individuals who are identified as a member of an ethnic group. This includes Black Americans, Hispanic Americans, Native Americans (American Indians, Eskimos, Aleuts, and Native Hawaiians), Asian-Pacific Americans (U.S. citizens whose origins are from Japan, China, the Philippines, Vietnam, Korea, Samoa, Guam, and the U.S. Trust Territories of the Pacific, Northern Marianas, Laos, Cambodia and Taiwan), and Asian-Indian Americans (U.S. citizens whose origins are from India, Pakistan, and Bangladesh). Other groups or individuals may be considered disadvantaged if certification is granted by the Small Business Administration according to Section 8(a) of the Small Business Act. |

Unified Certification Program (UCP) | The purpose of the UCP is to provide “one-stop shopping” to applicants for certification, such that an applicant is required to apply only once for a DBE certification that will be honored by all recipients in the state. In the past, a firm would be required to apply for certification as a DBE with each agency with which the firm wants to work. Under UCP, the firm applies one time with the state transportation agency, and if approved, that certification is shared by all other federal recipients in the state. The UCP eliminates the need for multiple DBE certifications with recipients of funding from the U.S. Department of Transportation. |
